1. Acceptance of terms

By accessing or using Bloombee ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

Bloombee is a free garden planning tool that allows you to draw your garden plot on a satellite map, place plants, simulate sun and shadow, and receive gardening advice. The Service is provided "as is" and "as available".

3. Account

You may sign in using your Google account. You are responsible for maintaining the security of your account. You must not share your account credentials or let others use your account.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or use automated tools to extract data from the Service
• Upload malicious content or attempt to exploit vulnerabilities
• Impersonate another person or entity

5. Your content

You retain ownership of the garden plans and data you create. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you. We will not share your garden data with other users or third parties without your consent.

6. Gardening advice disclaimer

The gardening advice, sun calculations, weather information, and plant recommendations provided by Bloombee are for informational purposes only. They are approximate and should not be relied upon as professional horticultural advice. Sun zone calculations are estimates based on building heights and positions, and may not reflect actual conditions. We are not responsible for any loss or damage to plants or property based on information provided by the Service.

7. Third-party services

The Service uses third-party services including Mapbox (satellite imagery), OpenStreetMap (map data), Open-Meteo (weather), and PostHog (anonymous analytics). Your use of these services is subject to their respective terms. We are not responsible for the availability or accuracy of third-party services.

8. Limitation of liability

To the maximum extent permitted by law, Bloombee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service (which is zero for the free tier).

9. Availability

We strive to keep the Service available, but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time without notice. We are not liable for any downtime or unavailability.

10. Intellectual property

The Bloombee name, logo, design, and code are owned by Bloombee. You may not copy, modify, distribute, or create derivative works of the Service without our permission.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases, but we may retain your data as required by law or for legitimate business purposes.

12. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.

13. Changes to terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of significant changes by posting a notice on the Service.
